Head of Romanian National Fiscal Authority ANAF: In two weeks we will be able to say whether OMV owes this solidarity contribution or not / For us all companies are equal, if they try to do financial engineering, I guarantee that they will not be able to get away with it

The head of Romanian National Fiscal Authority (ANAF), Lucian Heiuș, announced on Sunday, at Digi24, that in a maximum of two weeks he will be able to say if OMV owes or not the solidarity contribution to the Romanian state, reports news.ro. He said that for ANAF, all companies are equal and that there will be very strict and very thorough checks to determine which companies fall under this Ordinance. If companies try to do „those well-known financial engineering”, they will not be able to get away with it, warned Heiuș.

„We, as ANAF, can only do one thing, and we are going to do it extremely firmly, starting tomorrow, we will check not only OMV but all the companies that fall under the provisions of this Ordinance and from the first checks we will see if their turnover, 75% represents those NACE codes clearly set out in the Ordinance. Final checks cannot be made in the next few days because financial statements in Romania are finalized and submitted on May 30th, but with a 99.9% probability, in a maximum of two weeks I will be able to say whether OMV owes this solidarity contribution or not. In maximum two weeks,” said Heiuș.

He said that what ANAF will check will be „how they calculated and considered that the turnover in 2022 does not fall under this Ordinance”.

„OMV Petrom is a Romanian company, the only connection with OMV in Austria is that it owns 51.15% of OMV Petrom, and the dividends will be transferred in accordance with this percentage, otherwise, there is no connection between the activity it has in Romania and the fact that it has to pay taxes here, the activity in Austria and the tax to pay in Austria, because there could be other conditions,” the ANAF chief explained.

If OMV or any other company does not comply with this provision on solidarity tax, the ANAF will make a notice of tax liability and will start the execution of the company to recover the money it owes to the budget, he said.

„For us, all companies are equal and we will make these very strict and very thorough checks with the specialists we have, on all companies that should fall ( under the provisions of the Ordinance, no) and not let any escape without paying this contribution. And if they try to do those well-known financial engineering, I guarantee you that they will not be able to escape our attention and we will do everything possible to recover this money,” said Heiuș, quoted by news.ro.
